Frequent Amendments to RoHS Exemptions: How Can Exporters of Electrical and Electronic Products to the EU Conduct Self-Checks?

Published in English.

## Background CE-RoHS restricted substances certification is based on Directive 2011/65/EU and (EU) 2015/863, which set limits for 10 substances: lead, cadmium, mercury, hexavalent chromium, polybrominated biphenyls, polybrominated diphenyl ethers, and four phthalates. Cadmium is limited to 0.01%, and the others to 0.1% (all calculated by weight of homogeneous material). The difficulty of RoHS lies not in the 10 limits themselves, but in the **exemption clauses**. The European Commission grants time-limited exemptions for specific applications through a series of delegated directives, such as lead in high-temperature solders, lead in steel and copper alloys, and lead in certain glass ceramics. These exemptions all have expiry dates and have recently entered a window of intensive revision and renewal assessment. Once an exemption is no longer renewed, the previously legal material formulation becomes non-compliant. ## Frontline observations In sample submission and document pre-review over the past six months, we have noticed several high-frequency issues: | Phenomenon | Typical manifestation | Consequence | | --- | --- | --- | | Expired exemption cited | Technical files still cite expired exemption numbers | Direct rejection by notified body or customer audit | | Exemption scope mismatch | An exemption applicable only to specific materials is applied to the whole unit | Homogeneous material splitting is invalid, judged as exceeding limits | | Outdated supplier declarations | Upstream declarations issued more than 12 months ago | Cannot prove continuous compliance | | Exemption not indicated | Reports do not state the exemption clauses relied upon | Downstream customers cannot trace | The most common is the first category. Some companies' technical files (TCF) prepared in 2023–2024 have not been updated to date, and exemption numbers remain at old versions. RoHS compliance relies on an evidence chain at the **homogeneous material level**; a "whole-product qualified" conclusion at the finished-product level does not hold in customer or market regulatory sampling inspections. Another change is the standard of customer audits. Some EU importers have tightened the validity period of RoHS documentation from "updated with product versions" to "updated within 12 months," and require suppliers to list item by item in declarations the exemption numbers relied upon and their corresponding expiry dates. ## What companies should do **Step one: establish an exemption ledger.** List separately in a table the exemption number, applicable material, and expiry date corresponding to each homogeneous material in the BOM, avoiding vague citations at the finished-product level. **Step two: review exemption validity.** Confirm the status against the original text of the EU official exemption list, taking the official original text as authoritative and not relying on second-hand summaries. For clauses that have expired or are proposed not to be renewed, start alternative material verification in advance. **Step three: update the evidence chain.** Test reports, supplier declarations, and TCF should be consistent in time, and annual review is recommended. Reference range: the testing cycle for a single batch of 10 RoHS items is about 3–7 working days, with a cost of about RMB 1,500–5,000; if multiple homogeneous material splitting is involved, the cycle and cost will increase accordingly. **Step four: distinguish finished products from homogeneous materials.** For composite materials that cannot be split, the splitting logic should be explained in the TCF to avoid being deemed circumvention in audits. In RoHS projects, Shuwang Certification Platform undertakes document pre-review, recommendations for homogeneous material splitting plans, coordination of sample submission to partner laboratories, and rectification coaching; testing is completed by partner laboratories with CNAS/CMA qualifications, which issue reports, and the platform does not engage in testing activities. Companies can obtain the exemption ledger template and self-check list via https://www.shuwang-cert.com. ## Notes The cycles and costs described in this article are public industry reference ranges, and actual practice is subject to engineer assessment and laboratory scheduling. The RoHS exemption list is under dynamic revision; for the specific clause status, applicable conditions, and expiry dates, please refer to the official EU original text. This article does not constitute legal advice. **Service boundary statement**: Shuwang Certification Platform is an export certification solution service provider and does not engage in testing activities, nor is it a certification body. The tests described on this page are completed by partner laboratories with CNAS/CMA or equivalent qualifications, and certificates are issued by EU notified bodies (NB) or institutions authorized by the standards bureau of the destination country. The cycles and costs on this page are public industry reference ranges, and actual practice is subject to engineer assessment and institution scheduling. **One-sentence conclusion**: The risk point of RoHS compliance is shifting from "the 10 limits" to "the validity of exemption clauses." Companies should incorporate the exemption ledger into annual review rather than waiting for customer rejection before supplementing documents.
