Household physiotherapy device classified as Class IIa on Amazon Europe: Listing rectification caused by incorrect CE-MDR classification determination

Published in English.

A certain home health electronics manufacturer distributed a low-frequency pulse physiotherapy device (which stimulates muscles through electrode pads to relieve shoulder and neck soreness) to Amazon Germany and France. The product had previously been prepared according to the approach for ordinary consumer electronics, with only CE-LVD and CE-EMC testing completed, and no medical device pathway assessment conducted. In the first half of 2026, the seller received a category review notice in the backend, requiring supplementary medical device compliance documents.

The product is recognized in the EU as having a medical purpose and falls within the scope of Regulation (EU) 2017/745 (the EU Medical Device Regulation, referred to as MDR, i.e., the regulation under which medical devices entering the EU market must undergo conformity assessment according to risk classification). Because the intended use statement includes "relieving pain," the classification should be determined as Class IIa, rather than the ordinary electrical appliance as the company had assumed. The company lacked a basis for classification determination, clinical evaluation, technical documentation, and notified body involvement, resulting in the listing being suspended, inventory unable to be warehoused, and the packaging and instructions previously invested in needing to be redone.

Redo the classification determination according to Rule VIII of MDR Annex VIII, lock in Class IIa, and accordingly determine the conformity assessment pathway requiring notified body (NB) involvement. Organize the preparation of technical documentation (TCF), risk management documentation, and clinical evaluation reports, sort out the intended use, contraindications, and labeling language, and remove statements that could easily be judged as ordinary electrical appliances. Engage an EU notified body with MDR authorization scope to complete the review, and simultaneously prepare EUDAMED-related registration and EU authorized representative information.

After completing the classification determination and pathway switch, the product was resubmitted for platform review as a Class IIa device, and the listing was restored. The overall cycle is approximately 4–6 months, with a reference cost range of RMB 30,000–150,000, depending on the notified body's scheduling and the depth of clinical evaluation.

For household appliances with intended use statements such as "relieving pain" and "treatment," first conduct MDR classification determination before discussing CE, and do not default to handling them under LVD/EMC. The core of medical device compliance is intended use and classification; labels, instructions, and advertising wording must be consistent with the classification, and any single statement may change the regulatory pathway.
